There are some who claim that motels along freeways have increased the frequency of auto accidents. The data on incidents involving motels between freeways support this argument. It appears to be an argument that is valid at least in the beginning.
I believe, however, that the problem isn’t the number or severity of the accidents but rather the number and nature of the accidents that happen when people drive from one hotel along the highway to another. Also, it seems to me that the debate concerning the Commerce Clause is not really pertinent in the first place. The Commerce Clause is only applicable if the operation is profit-oriented. Why is the Commerce Clause in question when it comes to motel businesses? Because some people believe it makes it okay to discriminate against specific classes of people, and to discriminate against other groups of people.
This is not the problem. What is the problem is that the United States government has attempted to make use of the commerce clause as a way of protecting some individuals and to benefit other people. The 1964 Civil Rights Act was an illustration of the way in which the United States government tried to make use of the commerce clause in order to stop private businesses from discriminating when they hire. In essence, the government stated that if you decide to lease your motel rooms to African Americans then you must make sure that your skills in customer service don’t discriminate. It also said that when you hire someone who is a part of the mafia or gook, you need to ensure that the person doesn’t have any mafia ties or gook ties. It’s not an issue however the United States government, which was trying to shield its industrial sector from protectionist tendencies, stepped into this dangerous slope.
The result was that the Supreme Court ruled in the Loving decision that the Commerce Clause didn’t give the federal government the power to prevent individuals from being discriminated against during the selection process. The court ruled that the Loving decision that states that race, color and gender should not be used as grounds to discriminate was not relevant. This allowed private companies to pick and choose whom they’d hire based on anything that they considered to be important. Also, it’s not true that the writers of the Civil Rights Act intended for state action doctrine to ever be incorporated into the Civil Rights Laws.
The story of the Civil Rights Courts reveals an America where people could not be judgmental and did not have the right to be discriminated against based solely on their race or gender. That was the America which the United States Congress adopted in the 1960’s. It’s the America we would like to return to. We can hopefully take lessons from the past and quickly move on from this awful incident in our nation’s history.
